Terms of Use

1. Agreement to Terms

Kwomi is a mobile application owned and operated by True Top LLC (“True Top,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Kwomi app and the kwomi.com website (together, the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, please do not use Kwomi.

2. Eligibility

Kwomi is designed for parents, guardians, and adult family members. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use the Service. Children may use the app only under the direct supervision of a parent or guardian who has accepted these Terms.

3. Your Content and Ownership

You own your content.All artwork, photographs, scans, and other materials you create, upload, or import into Kwomi (“Your Content”) remain yours. True Top LLC does not claim any ownership rights over Your Content.

To provide the Service, you grant True Top LLC a limited, non-exclusive, royalty-free, worldwide license to store, process, display, reproduce, and transmit Your Content solely as needed to:

  • –Store and sync Your Content across your devices
  • –Display Your Content to you within the app
  • –Generate thumbnails, previews, and optimized versions for app functionality
  • –Export or share Your Content at your direction
  • –Fulfill print orders or other services you request

This license exists only to operate Kwomi's features and terminates when you delete Your Content or close your account. We do not use Your Content for advertising, marketing, or to train machine learning models.

4. Cloud Storage and Sync

Kwomi stores Your Content on your device and, if you enable cloud sync, in your private iCloud account via Apple's CloudKit framework. Cloud sync is designed to keep your library available across your Apple devices.

We work to provide a reliable experience, but we do not guarantee that cloud sync will be uninterrupted, error-free, or available at all times. Cloud storage depends on third-party infrastructure operated by Apple. You are responsible for maintaining your own backups of any content that is important to you. True Top LLC is not liable for data loss resulting from device failure, iCloud service disruptions, or other circumstances beyond our reasonable control.

5. Subscriptions and Billing

Kwomi may offer premium features (“Kwomi Pro”) through Apple's App Store as an auto-renewable in-app subscription. By subscribing, you agree to the following:

  • –Payment: is charged to your Apple ID account at confirmation of purchase.
  • –Renewal: your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date.
  • –Management: you can manage or cancel your subscription at any time through your Apple ID account settings.
  • –Free trials: if offered, any unused portion of a free trial is forfeited when you purchase a paid subscription.
  • –Pricing: subscription prices are shown in the App Store before purchase and may vary by region.

All billing and payment processing is handled by Apple. True Top LLC does not collect, process, or store any payment information. Refund requests should be directed to Apple through their standard App Store process.

6. Acceptable Use

You agree to use Kwomi only for its intended purpose and in compliance with applicable laws. You may not:

  • –Use the Service for any unlawful, harmful, or fraudulent purpose
  • –Upload content that infringes the intellectual property rights of others
  • –Reverse engineer, decompile, or disassemble any part of the app
  • –Interfere with or disrupt the Service, its servers, or connected networks
  • –Circumvent any access controls, security features, or usage limits
  • –Use the Service to distribute malware, spam, or other harmful material

We reserve the right to suspend or terminate access for any user who violates these rules.

7. Intellectual Property

The Kwomi name, logo, app design, website content, and all related trademarks, graphics, and software are the property of True Top LLC and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use the Kwomi brand or proprietary materials except as needed to use the Service as intended.

8. Third-Party Services

Kwomi relies on services provided by Apple, including iCloud/CloudKit and App Store billing. Your use of those services is subject to Apple's own terms and privacy policies. True Top LLC is not responsible for the availability, performance, or practices of any third-party service. If you export or share content to a third-party app or platform, that content becomes subject to that service's terms.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, True Top LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by applicable law, True Top LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, content, artwork, profits, or goodwill — arising out of or related to your use of the Service. Our total cumulative liability for any claims related to the Service shall not exceed the amount you paid to True Top LLC in the twelve (12) months preceding the claim, or fifty dollars (US $50), whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless True Top LLC, its officers, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

You may stop using Kwomi at any time by deleting the app from your device. If you have an active subscription, you must also cancel it through your Apple ID account settings to prevent future charges.

We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a manner that is harmful or disruptive. Where practicable, we will provide notice before taking action. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive — including ownership, disclaimers, liability limitations, and indemnification — will remain in effect.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and True Top LLC regarding the Service. They supersede any prior agreements or understandings, whether written or oral, relating to your use of Kwomi.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. For material changes, we will provide additional notice where appropriate, such as a notification within the app. Your continued use of Kwomi after updated Terms take effect constitutes your acceptance of those changes.
